This literature review examines pro-charge and pro-prosecution strategies, exploring the consequences of allowing Crown prosecutors the discretion to divert abusers to alternative measures prior to charge approval. As well, this paper examines the creation of domestic violence courts in various Canadian and American jurisdictions and how those courts have utilized diversion as an alternative answer to prosecution within the criminal justice system.

Structured professional guidelines are designed to assist the process of risk assessment and management by requiring evaluators to consider, at a minimum, a set of risk factors deemed important in the scientific and professional literatures. The RSVP is similar to previous guidelines in many respects, but also incorporates new features that we hope will increase its utility in risk management and forensic decision-making. These new features include: specification of procedures for obtaining assessment information, including past sexual violence, to assist anamnestic analysis; expended consideration of risk factors related to manageability; separate coding of judgements concerning the presence and relevance of risk factors; and incorporation of scenario-based risk assessment methods.
